In this privacy notice we inform you about the processing of your personal data.

Contact form
You can contact us by using a contact form provided on our website. After submission of the contact form, the controller will process the personal data you have provided for the purpose of handling your request on the basis of your consent which you have given by submitting the form according to Art. 6 (1) (a) GDPR, until revocation.
You have no legal or contractual obligation to provide personal data. If you do not provide such data, you are simply not able to submit and we are not able to process your request.

WP Statistics
We use the local analysis software WP-Statistics, WordPress to process your data for the purpose of troubleshooting, failure analysis and statistical analysis and to identify measures for the sophistication of our website.
This service is a local analysis tool so that no personal data are transferred to the service provider or to third parties. Furthermore, your personal data are anonymized immediately after such data were collected. Personal data are therefore not stored beyond initial processing.
The legal basis of processing is the legitimate interest (absolute technical necessity to provide and to deliver the “website” service which you have explicitly requested by visiting the website according to Article 6 (1) (f) GDPR combined with § 25 TTDSG.
Right to object
You have the right to object to processing if your personal data is processed based on legitimate interests.
We will then cease the processing carried out on this basis, unless there are compelling and legitimate reasons for us to do so.
You have the right to object to the processing of your personal data for the purpose of direct marketing. In this case, we will cease the processing of your personal data for the purpose of direct mail.
The withdrawal of consent shall not affect the lawfulness of processing based on consent before its withdrawal.
Withdrawal
You have the right to withdraw your consent at any time by changing the settings at Privacy settings.
If you have given your consent to receipt of advertising by email, you may withdraw your consent by clicking the unsubscribe link. In this case, we will cease the processing operations, unless there is any other legal basis.
The withdrawal of consent shall not affect the lawfulness of processing based on consent before its withdrawal.
Right to data subject
You have the right to access to, rectification, erasure and restriction of processing of personal data.
You have also the right to data portability if the processing of your personal data is based on your consent or on a contract concluded with you.

WorkAttend mobile app
1. Location Data
Our app collects your device’s location only when you actively use the Clock In / Clock Out feature. This allows us to record your location at the time of your attendance submission and ensure accuracy in your time logs.
We do not track your location in the background and we do not collect continuous location updates.
2. Camera & Face Punch Verification
We use your device’s camera to capture a photo during Clock In / Clock Out for identity verification through our Face Punch feature.
These photos are used solely to confirm your identity and are stored securely.
We do not use them for facial recognition profiling, training, or analysis beyond attendance verification, and we do not share them with any third parties.
3. Data Storage & Retention
All location data and attendance photos are stored on secure servers with restricted access.
Attendance-related data (including photos) is retained only for as long as required for attendance verification, auditing, or as required by your employer’s policy, after which it is permanently deleted.
4. Data Sharing
We do not sell, share, or disclose your location data or camera data to any third parties.
Data is used exclusively to support accurate, secure, and reliable attendance tracking.
5. Legal Basis for Processing
Depending on your region, we process this data under one or more of the following legal bases:
- Performance of a contract (to accurately record your attendance)
- Legitimate interests (fraud prevention and identity verification)
- User consent, where required by law (e.g., camera access permissions)

7. Security Measures

This cookie notice explains which cookies WorkAttend uses on this website, the types of data they hold, why we need them, how long they last and how you can change your choice. It should be read together with our Privacy notice.
What are cookies
Cookies are small files which are stored by your browser on your computer, tablet or smart phone. Each cookie holds data specific to you and to the website. Similar technology, such as your browser’s local storage, works in the same way and is covered by this notice too.
What cookies do we use
The cookies on this website can be categorised as follows:
- Strictly necessary - used to remember your cookie choice and simple settings such as the voice chosen for Rosa, our talking guide, and whether you closed her invitation. These stay on your device, are not used to identify you and cannot be switched off.
- Performance & analytical - only if you click “Accept”, we use Google Analytics 4 (Google Ireland Limited) to count visits and see which pages and features are used, so we can improve the website. Until you accept, or if you click “Reject”, Google Analytics is not loaded and no analytics cookies are set.
- Functional - we do not currently use functional cookies. The AI assistant, the demo booking form and the contact form work without setting cookies.
- Advertising - WorkAttend does not use advertising or social media cookies.

Third parties
The Google Analytics cookies are set on our domain but managed by Google, which may process the data outside the EU, including in the United States. See the Google Privacy Policy.
Location in the WorkAttend app
This website does not access your location. The WorkAttend mobile app uses your device’s location only when you clock in or out, to confirm you are inside your work site’s geofence, as described in our Privacy notice.
How to change your choice
You can change your choice at any time with the Cookie settings link here (the Privacy notice link at the bottom of every page brings you back to this notice). Choosing “Reject” stops Google Analytics and deletes its cookies from this website.
You can also block or delete cookies in your browser settings. Guidance is available at Cookiepedia, AboutCookies.org and AllAboutCookies.org. If you block all cookies, some parts of the website may not work as intended.

Data protection policy

Introduction
This policy sets out how Dakar Software Systems protects the personal data handled through WorkAttend, in line with the EU General Data Protection Regulation (GDPR) and the Maltese Data Protection Act (Cap. 586).
Our role
- Controller - for data about visitors to this website, people who book a demo or contact us, and our customers’ account contacts.
- Processor - for the attendance data our customers record about their own employees in the WorkAttend app and portal (clock-in/out times, sites, jobs and the location at the moment of punching). The employer is the controller of that data and we process it only on their documented instructions, under a data processing agreement.
Principles we follow
- Lawfulness, fairness and transparency - we only process data on a valid legal basis and explain it in our Privacy notice.
- Purpose limitation - data is used only for the purpose it was collected for.
- Data minimisation - we collect only what is needed. The app checks location only at the moment of clocking in or out, never in the background.
- Accuracy - data can be corrected by the customer’s administrators or on request.
- Storage limitation - data is kept only as long as needed, then deleted or anonymised.
- Integrity and confidentiality - data is protected by appropriate technical and organisational measures.
- Accountability - we document our processing and can demonstrate compliance.
Security measures
- Encrypted connections (HTTPS/TLS) between the app, the portal and our servers.
- Role-based access, so each administrator sees only the data they are allowed to see.
- Staff access on a need-to-know basis, bound by confidentiality.
- Regular backups and software updates.
- Protection against location spoofing: punches made through VPNs or fake-location tools are flagged to the responsible department.
Service providers
We use carefully selected providers that act on our instructions, for example email delivery for booking confirmations, an AI service that answers questions in the website chat, and (only with your consent) Google Analytics. Where data leaves the EU/EEA, we rely on adequacy decisions or the European Commission’s Standard Contractual Clauses.
Retention
Demo bookings and contact messages are kept for as long as needed to handle the request and follow up. Customer attendance data is kept for the period set by the customer’s contract and deleted or returned when the contract ends, unless the law requires us to keep it longer.
Your rights
You have the right to access, correct, delete, restrict or object to the processing of your personal data, the right to data portability and the right to withdraw consent at any time. If you are an employee using WorkAttend through your employer, please contact your employer first; we will help them answer your request.
Personal data breaches
If a breach affecting personal data occurs, we act immediately to contain it, inform affected customers without undue delay and, where required, notify the Information and Data Protection Commissioner within 72 hours.
