Terms and Conditions

Access to and use of the WorkAttend System is subject to the following Terms and Conditions.
WorkAttend reserves the right to update and change the Terms of Service without notice. You can review the most current version of the Terms of Service at any time here. Violation of any of the terms below will result in the termination of your account. You agree to use the Service at your own risk.

1) SCOPE AND DEFINITIONS

1.1 By means of WorkAttend, a registered Customer can:
A. View invoices and subscriptions on the Customer’s Account/s. If the Customer wishes to keep a record of invoices for personal use the invoices can be saved in PDF format or printed (via browser).
B. carry out online payments using the Customer’s authorised credit/debit card in return for which the Customer settles in whole or in part the amount due on his/her subscription invoice with WorkAttend.

1.2 For the scope of these terms and conditions:

  1. “Account” means the Customer’s account for any WorkAttend subscription packages.
  2. “Customer” means the person named as Account Holder, who must also be the signatory to the Agreement with WorkAttend and includes any person who we reasonably believe to be acting with your authority, and the meaning of the term “your” shall be construed accordingly;
  3. “Invoice” means the invoice, which is calculated on the rates and charges agreed, in which a customer is subscribed by means of an agreement with WorkAttend.
  4. “WorkAttend.com” is the web portal whereby a customer logs in to benefit from the web services made available through the online systems by WorkAttend.

2) WORKATTEND RIGHTS AND OBLIGATIONS

2.1 WorkAttend undertakes to:

  1. Provide the Customer with a secure system which enables the Customer to have his/her credit/debit card charged by amounts so authorised by the Customer.
  2. Guarantee the security of WorkAttend as far as within its control.
  3. Take all reasonable steps and precautions to protect any information stored within its online systems provided at the point of its transmission to WorkAttend.
  4. Reserves the right to discontinue the availability of services provided by WorkAttend, in which case Customer will be notified accordingly in advance.
  5. WorkAttend reserves the right to change the service and the applicable Terms & Conditions at any time, in which case Customer will be notified accordingly in advance.
  6. If a WorkAttend plan is upgraded or downgraded, the new rate will be applied on the next billing cycle (next month or year depending on the subscription) and will be automatically taken based on the payment details provided.
  7. Downgrading the Service will result in the loss of content, features or the capacity of an Account. WorkAttend does not accept any liability for such loss.

3) CUSTOMER’S RIGHTS AND OBLIGATIONS

3.1 The Customer acknowledges that by subscribing to WorkAttend he/she/X is subscribing to e-billing and therefore will not be in receipt of invoices via normal mail. The Customer can login via their WorkAttend.com account to view the invoice and/or download and print it as required.
3.2 The Customer acknowledges further that he/she/X shall:

  1. Input onto WorkAttend.com, any information as may be requested by WorkAttend in respect of personal and/or credit/debit card details.
  2. Input onto WorkAttend.com only credit/debit card details which the Customer is legally authorised to use. In default of which, Customer would be deemed to be abusing of WorkAttend.com and be in breach of these terms and conditions.
  3. To honour all payments originating and incurred through his/her online booking of the Service/s;
  4. Indemnify and hold harmless WorkAttend.com for any losses suffered by WorkAttend if Customer is in material breach of any one or several of the terms and conditions contained herein.
  5. Not transfer any rights and/or obligations under these terms and conditions to any third party.
  6. To notify WorkAttend immediately in writing of any changes to Customer’s personal details, including email/postal address, as given to WorkAttend.com on registering with ‘WorkAttend’.
  7. A valid payment method (credit card or debit card) is required for using the WorkAttend services after the 14-day trial has expired.

3.3 Customer understands and accepts that he/she/X is hereby accepting responsibility for all transactions which originate through the ‘WorkAttend.com’ account, and that all subscription services shall be due and payable by Customer to WorkAttend.
3.4 Customer understands and accepts that these terms and conditions must be read in conjunction with WorkAttend Standard Terms and Conditions, any other document or policy referred to therein and any other terms and conditions applicable to a particular transaction.

4) CONFIRMATION OF PAYMENT

4.1 Customers who settle their invoices via WorkAttend shall receive an email confirming amount paid. This email is not a fiscal receipt. Your next invoice is the fiscal receipt.
4.2 Customers who bought a subscription via WorkAttend.com shall receive an email confirming amount paid. This email is a fiscal receipt. Customers shall not receive a hard copy receipt for the transaction.
4.3 WorkAttend shall not be liable for any damages if an automated email is not issued.
4.4 At the beginning of every billing period, a company on a paid plan that has entered their billing/credit card details will be charged based on the number of employees that have used the mobile application to clock in or out, available in their organisation.
4.5 At the next billing period, any additional employees added in the for the previous month will be charged depending on the selected plan. An employee will be calculated into your bill if they Clocked in/out once.
4.6 All fees are exclusive of all taxes, levies or duties imposed by taxing authorities and you shall be responsible for payment of all such taxes, levies, or duties in your respective country of residence.

5) REFUNDING YOUR MONEY

5.1 The Service is billed in advance on a monthly or annual basis and is non-refundable. There will be no refunds or credits for partial months/years of service, downgrades, or unused months with an open account. To treat everyone equally, no exceptions will be made.

6) CANCELLATION

6.1 If you cancel your subscription before the end of your billing period (monthly or annual), your cancellation and downgrade will take effect immediately and you will not be charged again.
6.2 You can delete your account by contacting the WorkAttend team through the website support page. Your Account will then be removed by our team in a timely manner and will verify when this process has been completed through an email confirmation.
6.3 All your content will be immediately deleted from WorkAttend upon deletion. This information cannot be recovered once your Account has been removed.
6.4 WorkAttend at its sole discretion has the right to suspend or terminate your Account and to refuse all current or future use of WorkAttend, for any reason at any time. Such termination of WorkAttend will result in the deactivation or deletion of your Account.
